Terms of Service

1. Agreement to Terms

By accessing or using the services provided by GetMetaFunnel (operated by Justin Yee Solutions, Registration No. 202303182069 / RA0102137-X), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

GetMetaFunnel provides digital advertising and funnel management services, including but not limited to:

• Meta (Facebook & Instagram) advertising campaign setup and management
• Conversion funnel strategy and implementation
• Lead generation and tracking infrastructure
• Performance reporting and analytics
• Landing page and creative consultation

3. Service Agreement & Payment

3.1 All service engagements require a signed service agreement or proposal acceptance prior to commencement.

3.2 Fees are as quoted in individual proposals and are payable in Malaysian Ringgit (RM) unless otherwise agreed.

3.3 Ad spend budgets are separate from management fees and are paid directly to Meta Platforms by the client.

3.4 Late payment beyond 14 days may result in service suspension. Outstanding amounts may incur a late fee of 1.5% per month.

4. Client Responsibilities

• Provide timely access to Meta Business Manager, ad accounts, and relevant assets
• Ensure all provided content, imagery, and claims comply with applicable laws and Meta's Advertising Policies
• Respond to approval requests within 48 hours to avoid campaign delays
• Maintain an active Meta Business Manager account in good standing

5. Performance Disclaimers

5.1 While we use data-driven strategies to optimise performance, we do not guarantee specific results including but not limited to lead volume, cost-per-lead, ROAS, or conversion rates.

5.2 Performance metrics shared on our website (including case studies and benchmarks) represent past results and are not guarantees of future performance.

5.3 Ad platform algorithm changes, market conditions, and audience behaviour are beyond our control and may affect campaign performance.

6. Intellectual Property

6.1 Campaign strategies, funnel architectures, and proprietary methodologies developed by GetMetaFunnel remain our intellectual property.

6.2 Ad creatives produced during the engagement are licensed to the client for use during the active service period. Full transfer of creative ownership may be arranged separately.

6.3 Client-provided assets (logos, brand materials, product images) remain the client's property.

7. Termination

7.1 Either party may terminate the service agreement with 30 days' written notice.

7.2 Upon termination, the client will receive access to all running campaigns and accumulated data within their ad accounts.

7.3 Fees for work completed up to the termination date remain payable.

8. Limitation of Liability

GetMetaFunnel's total liability for any claim arising from services shall not exceed the total fees paid by the client in the three (3) months preceding the claim. We shall not be liable for indirect, incidental, or consequential damages including lost profits or business opportunities.

9. Confidentiality

Both parties agree to keep confidential any proprietary information, business data, campaign performance data, and strategic information shared during the engagement. This obligation survives termination of the service agreement.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
